On the Side of Evidence

As part of our first project, we are examining the European patents of inventors Antal Rogán, Balázs Csík and Csaba Lengyel, which are in force in Hungary under the registration numbers E038266 and E058164.

Based on our preliminary technical and legal assessment, our first step will be to initiate proceedings before the Hungarian Intellectual Property Office (HIPO) seeking the revocation of the Hungarian national effect of these patents.

Subject to the outcome of those proceedings and the resources available, we will also consider initiating appropriate legal proceedings in respect of the corresponding national patent rights in other countries where these European patents are in force.

Why Does This Matter?

Where well-founded technical or legal questions arise regarding the validity of a patent, the patent system provides a mechanism for an independent, evidence-based review. This is not a weakness of the system, but one of its fundamental safeguards.

The first PatentReview project therefore extends beyond a single patent dispute. Its objective is to demonstrate that the technical and legal review of a patent attracting significant public interest can be conducted transparently and on the basis of publicly verifiable evidence.

We believe that initiatives of this kind can help strengthen public confidence in the patent system, promote legal certainty, and support fair competition, regardless of who the inventors or patent proprietors may be.
